This information, pursuant to Article 13 of the European Regulation 2016/679 of the European Parliament and the Council, are made in compliance with the provisions of Legislative Decree 196/2003 and subsequent amendments of the Republic of Italy , to the Provision of the Data Protection Authority for the protection of data n. 229 dated 8 May 2014,as well as the Directive  2002/58/CE of the European Parliament and the Council.

Definition of Cookies

Types of Cookies

Italian Legislation (Article 122 of Legislative Decree 196/03 “Personal Data protection Code hereinafter “Code”) has introduced into our legal system the Community Directive 2009/136/CE which requires website managers to use cookies or other tracking technologies to inform the user about the types of cookies used by the website. The Provision of the Personal Data Controller n 229 dated 8 May 2014, published on the Official Gazette n. 126 dated 3 June 2014, categorised cookies in two macro categories known as “technical” cookies and “profiling” cookies.

  1. Technical Cookies, normally installed by the owner or manager of the website, have to purpose of “carrying out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the contracting party or user to provide such service” (see Article 122, paragraph 1, of Privacy Code). Technical cookies are further divided in :

  1. Session Cookies, which guarantee normal browsing and use of the website allowing, for instance, to make a purchase or to authenticate to access restricted areas. These cookies are not stored permanently on the device used by the user and are automatically deactivated when the browser is closed . Their use is linked to the transmission of personal data necessary to allow safe and efficient navigation on the web pages. Session cookies do not allow, in any way, the acquisition of the user’s personal data.

Article 122 of the Privacy Code refers to them stating that “the filing of information in the terminal device of a contractor or user or the access to information already archived are permitted only on condition that the contractor or user has given their consent after have been informed with the simplified procedures referred to in Article 13 of the Privacy Code, paragraph 3″ (Article 122, paragraph 1 of the Code).

In the same Provision the Personal Data Controller has further categorised cookies according to the subject operating as data controller of personal data, making a distinction between first-party cookies and third-party cookies.

First-party Cookies
These cookies are managed by the owner of the website. The obligation to provide information about these cookies lies with the owner of the website. Moreover, it is up to the latter to indicate how to possibly block these cookies.

Third-party Cookies
These cookies are managed by a third party different from the owner of the website. The obligation to provide information and indication of the methods on how to possibly block these cookies lies with the third party, while the owner of the website is obliged to add the link to the site of the third party, in which such elements are available, on the website.
